Terms of business
Working draft, prepared for review. It has not yet been checked by a person and is not presented as legal advice. Bracketed items are completed before launch.
These terms cover video production commissioned from Mossy Marketing, a trading name of Moez Anwar, sole trader (address for service to be confirmed), called “we” below. “You” is the brand commissioning the work. We sell to businesses only, so consumer protection rules for individuals do not apply to these purchases.
1. What we supply
A pack is three short vertical videos, each filmed by a different UK creator using your product in their own home, edited for paid social and delivered ready to upload. A trial is one video from one creator on the same terms. The creators do not publish the videos anywhere: the footage is made for you to run as ads on your own accounts.
A campaign is a separate managed service: we source, vet, brief and contract UK creators who post about your product to their own audiences, and we manage the campaign to a completion report. The management fee is £150 per creator, minimum three creators, invoiced half on brief sign-off and half on completion. You pay each creator directly at the rate agreed before contracts are signed; we never hold, advance or pass through creator fees. Your rights to reuse campaign content are set out in each creator’s contract. Clauses 2, 3 and 4 below apply to footage packs and trials; for campaigns, the equivalent points are fixed in the campaign brief and the per-creator contracts. No campaign includes creator fees, ad spend, or any guarantee of results.
2. What you supply
- A completed brief: the product, who buys it, the angles you want, and anything the videos must say or must not say.
- The product itself, sent to each creator at your cost. Products are not returned unless agreed in advance.
- Confirmation that the product is safe and legal to sell in the UK, and that any claims you ask us to include can be substantiated.
3. Price and payment
- The price is the one quoted when you book: currently £600 for a pack and £195 for a trial.
- Half is paid up front as a deposit before casting begins. The balance is invoiced on delivery of the edited videos and is payable within 7 days.
- VAT position to be confirmed.
4. Timescale
Delivery is ten working days from the later of your deposit clearing and our receiving the product and completed brief. If anything threatens that date, we tell you straight away rather than quietly missing it.
5. Revisions
One revision round is included: collect your change requests into one list within 14 days of delivery and we re-edit once at no charge. Further rounds, or changes to the brief after filming, are quoted separately before any work is done.
6. Rights and ownership
- On final payment you receive a perpetual, irrevocable, worldwide licence to use the videos and the raw footage in paid media and on your own brand channels, forever.
- The raw files transfer to you with final payment.
- The creators retain no right to publish or reuse the footage.
- Until final payment clears, the footage remains ours and may not be published.
- We may not name you or show the work publicly without your written permission.
7. Compliance
Every edit is checked against the ASA’s advertising codes and the Digital Markets, Competition and Consumers Act rules before delivery. You remain responsible for claims that depend on facts only you can substantiate, and for how and where the ads are run.
8. Cancellation
- Cancel before you approve the casting: your deposit is returned, less any costs already committed.
- Cancel after filming has begun: the deposit is retained.
- After delivery: the full price is due.
9. Liability
Our total liability for a project is capped at the price you paid for it. We are not liable for indirect or consequential loss, including lost profit or ad spend. Nothing in these terms limits liability that cannot lawfully be limited, such as fraud, or death or personal injury caused by negligence.
10. General
- These terms plus your accepted brief are the whole agreement for a project.
- Changes to these terms bind only if agreed in writing (email counts).
- If a court finds part of these terms unenforceable, the rest still stands.
11. Governing law
These terms are governed by the law of England and Wales, and the courts of England and Wales have exclusive jurisdiction.
